By accessing or using PulseWell ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Service Description

PulseWell is a wellness reference platform that uses artificial intelligence to provide Traditional Chinese Medicine (TCM) inspired wellness information. Our service:

• Provides general TCM constitution analysis
• Offers wellness and lifestyle suggestions
• Generates body type cards for personal reference
• Provides tongue image analysis for reference purposes

PulseWell is NOT a medical service. It does not diagnose, treat, cure, or prevent any disease or medical condition. Always consult a licensed healthcare professional.

3. No Medical Advice Disclaimer

All content provided by PulseWell is for informational and educational purposes only.

• Establish a doctor-patient relationship
• Provide medical diagnosis or treatment plans
• Prescribe medications or herbal formulas
• Replace professional medical consultation
• Handle medical emergencies

If you are experiencing a medical emergency, call your local emergency number immediately. Do NOT use PulseWell for urgent medical situations.

4. User Responsibilities

As a user of PulseWell, you agree to:

• Provide accurate information during consultations
• Not use the Service for emergency or urgent medical situations
• Consult a healthcare professional for any medical concerns
• Not rely solely on PulseWell for health-related decisions
• Be at least 16 years of age
• Not upload images of other people without their consent

5. AI-Generated Content

PulseWell uses artificial intelligence (Anthropic Claude) to generate wellness content. You acknowledge that:

• AI-generated content may contain inaccuracies
• TCM concepts are translated for a global audience
• AI knowledge is based on training data with a knowledge cutoff date
• You should verify important health information with a qualified professional

6. Intellectual Property

The PulseWell name, logo, website design, and original content are protected by copyright and trademark laws. Body type cards generated by the Service may be shared for personal, non-commercial use with proper attribution to PulseWell.

7. Limitation of Liability

To the fullest extent permitted by law, PulseWell and its creators shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from use or inability to use the Service, reliance on AI-generated wellness information, health decisions based on Service content, or technical issues. PulseWell is provided "AS IS" without warranties of any kind.

8. Subscription & Payments

PulseWell currently offers free services during its Early Access phase. When paid subscriptions become available: pricing will be clearly displayed before purchase, free trials will clearly state the trial period and post-trial pricing, you may cancel anytime, and refund requests are handled per our Refund Policy (14-day window for EU residents).

9. Refund Policy

For EU residents: You have a 14-day right of withdrawal from the date of purchase. To request a refund, contact us at support@pulsewell.com. Refunds will be processed within 14 business days.

10. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time through your account settings. Upon deletion, your data will be permanently removed within 30 days.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For EU users, mandatory consumer protection laws of your country of residence also apply.

12. Changes to Terms

We will notify users of material changes to these Terms via email at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance.
